Don’t Fear Filing A Claim

All our team members are North Carolina Board Certified Workers’ Compensation attorneys. Since our inception, Cardinal Law Partners have worked with hundreds of claimants who have varying levels of concerns and worries about filing Workers’ Compensation claims. Most clients are apprehensive when it comes to recovering damages because of potential retaliation from their employers. Cardinal Law Partners is here to assure you are entitled to Workers’ Comp benefits and can file a claim to receive them.

Employers Are Not The Ones Paying For Damages

In many cases, a Workers’ Compensation claim has an employer and an insurance company named in the case. Every employer in North Carolina that has three or more employees is required by law to offer Workers’ Compensation coverage. Companies that fail to follow this mandate face substantial fines and penalties.

When a Worker’s Compensation claim is filed by an employee, the Industrial Commission wants to know the names of the employer and its insurance carrier.

Even though both the employer and insurance company are named, it is rare for employers to pay any of the Workers’ Compensation benefits. The employer typically pays the premiums to the insurance company, which will facilitate the claimant’s financial compensation.

Employers Shouldn’t Get Upset When Their Employees File Workers’ Compensation Claims

Employers should not be concerned because most of the time their insurance carriers are paying the medical bills and lost wages of their injured workers. Most employers understand that employees will sustain workplace injuries from time to time. The best employers actually show support for their workers by being realistic about the injured workers’ physical restrictions and their abilities to perform their assigned duties.

Employers typically accept the fact that injuries do occur. As long as the employee is honest about how the accident happened, most employers will resolve the problem in a professional manner. Employees should avoid exaggerating and only provide honest details during routine investigations.

What Should You Do If An Employer Rejects Your Workers’ Compensation Claims?

It is illegal for employers in North Carolina to retaliate against employees who’ve filed Workers’ Compensation claims. The state has a Retaliatory Employment Discrimination Bureau and it is tasked with enforcing the Retaliatory Employment Discrimination Act. Most employers and employees refer to this law as “REDA.”

REDA is a law that protects employees that engage in protected activities. This includes filing Workers’ Compensation claims and bringing forward employer safety violations. Employees should understand that although it can be frightening to file Workers’ Compensation claims, it is unlawful for any employer to go after employees who file them in good faith.
